New York Crane Deaths Point to Need for Better Safety Practices

Wednesday, March 31st, 2010

A construction crane owner and his mechanic are facing manslaughter charges in New York because of deadly accidents in which two workers were killed and another seriously injured because of a faulty repair on their equipment. Read full story here.  In a separate incident, some months before this accident, another crane owned by the same company collapsed in Manhattan killing seven people. New York Buildings Commissioner Robert LiMandri reportedly called the charges an important reminder of the construction companies’ responsibility.

While fatal work injuries in the private construction sector declined according to the most recent figures from the Census of Fatal Occupational Injuries – down 20 percent in 2008 from 2007 – there is still a need for more diligence as it relates to crane safety practices. The Center for Construction Research and Training (CPWR) reports that the average number of worker deaths involving construction cranes at 42 a year. The leading cause of fatal crane accidents is cranes coming into contact with power lines; other causes, almost all preventable, include the crane collapsing or worker being struck by a crane boom/jib.

While crane accidents may not happen with much frequency, the results of this type of accident can be devastating in terms of injury or death. Furthermore, operators are not the only ones at risk. Other construction workers and individuals who just happen to be near the site are in just as much danger if a crane drops its load or tips over.

Injuries and deaths resulting from crane accidents are complex legal cases. They require lawyers experienced in wrongful death litigation and serious injury cases. If you or someone you know has been injured as a result of a crane accident, Blackman Legal Group has the experience to advise you. Contact the firm at 1-866-528-8115 for a consultation.

Bus Catches Fire After Accident

bus flames

A school bus pulling into the school parking lot caught fire after being hit by a car head-on in New Bedford, MA.

The collision occurred after the driver of the car passed out, he said, and swerved into oncoming traffic. Both vehicles were moving at slow speeds when the head-on collision happened.

No students were seriously injured in the accident, but the driver of the car was taken to the hospital. Many of the students disembarked and went immediately into the school building. Police are still investigating exactly how many students were on the bus.

It was only after the collision that the bus began to smoke and caught fire.

Car, bus and truck collisions can be dangerous for drivers and bystanders, causing personal injuries to all involved. A car accident lawyer can help you understand your rights. Contact an experienced lawyer at Blackman Legal Group at 1-888-395-3551.

Train Collides with Warehouse, Killing Four and Injuring Three

Wednesday, March 31st, 2010

A bizarre and nightmarish train accident turned into a fatal collision in Norway on March 24 when 16 freight cars jumped the track and crashed into a warehouse in Oslo.

The freight cars weren’t attached to an engine, yet somehow began rolling downhill on the tracks. As the cars rolled over several miles of track, they picked up speed before derailing and colliding with a warehouse. The collision caused the warehouse to collapse.

Four people were killed and three were catastrophically injured in the bizarre accident. All the people who were killed or injured were working near the warehouse that collapsed.

The railroad company does not yet know the cause of the accident.

Regardless of what caused this particular series of events, these kinds of fatal accidents illustrate just how dangerous trains can be. None of the victims of the collision were on the train and the freight cars weren’t even supposed to be moving.

If you have experienced a brain injury, spinal injury, or other serious injury as a result of a train accident, you should contact an experienced train accident lawyer. The regulations governing trains can be particularly complex and a lawyer with experience can help guide you through your rights. Malfunctioning Wheelchair

Tuesday, March 30th, 2010

Sometimes justice can take a long time, as is the case with the death of Jeff Thompson, a quadriplegic whose death in 2007 is believed to be the result of a malfunctioning wheel chair and negligence on the part of technicians from the National Seating and Mobility Company.

Jeff had been using a wheel chair since he was in a car accident as a teenager which resulted in a spinal injury that rendered his limbs useless.  Since the accident, he became a passionate advocate for accessible public transportation in the Boston area.

Three years ago, Jeff was in the care of two technicians who had neglected to remove him from his motorized chair or turn off the battery while making adjustments to a chair which they already knew was functioning improperly.  The technicians were making adjustments to his wheelchair when it violently flung him to the floor, causing him to have intractable seizures.  The technicians were slow to attain help, and Jeff died the next morning in the hospital from complications due to his seizures.  Not until three years later, however, were any charges filed against the National Seating and Mobility Company.  That all changed when Jeff’s father, Charlie Thompson, opened up a $10 million lawsuit against the company for neglect, and product liability.

Wrongful death, or injury, due to malfunctioning equipment and inattentive staff can leave you feeling powerless, however there is someone you can call; the lawyers at Blackman Legal Group.  The Personal Injury Attorneys at Blackman Legal Group can be reached toll free at 1-888-395-3551.

Man Hit by Train Loses Legs

Tuesday, March 30th, 2010

A Pittsburgh, Penn., man lost his legs on March 24 when a train hit him. Investigators said no motor vehicle was involved; the accident was simply a matter of someone being on the tracks.  Read full story here.   While the Federal Railway Administration (FRA) reports that train accidents are down – in 2009 they declined 25 percent – still tragic train accidents occur every year resulting in serious injury and death. Because of their size, weight and speed, it is physically impossible for trains to stop immediately if someone or another vehicle is on the track.

Train conductors and engineers are responsible for doing everything possible to prevent train accidents, yet human errors occur. Of greater concern, negligence is sometimes directly responsible for rail accidents. There are reported cases of conductors talking on their cell phone and even text-messaging someone causing one train to collide with another.

Train accidents occur too because of mechanical failure, including malfunction of crossing arms, warning bells and lights or derailment, in which case a train actually leaves the tracks.  Trains can derail for a number of reasons, including broken or misaligned rails, obstruction on the tracks, excessive speed or a collision with another object or vehicle. In 2009, there were 1308 train derailments in the U.S.

As trains continue to achieve new breakthroughs in speed, railway transportation will become more convenient for passengers and cargo transport. Even with the best safety measures, accidents are bound to happen.

If someone you know has been seriously injured or killed by a train contact the train accident lawyers at Blackman Legal Group.  The toll-free number is 1-866-528-8115.  They are experienced at fighting to recover substantial settlements for victims and their families in serious cases.
