Fog Blamed: Man Hit by Car While Pushing Disabled Vehicle on I-5

Heavy fog was cited as a factor in a fatal accident early Tuesday morning on Interstate 5 in Stockton. A man who was pushing a disabled car was struck and killed by another vehicle.

•  A man was pushing his disabled vehicle on the freeway in the heavy fog. There was no shoulder where he could pull over or walk to safety because of road construction.

•  Another car came up from behind at freeway speed and did not see the man because of the heavy fog. That car slammed into the man and his vehicle. 

•  The man died immediately. Police said fog was a factor but didn’t yet know if the driver also was at fault.

The deadly freeway crash occurred at about 3:30 a.m., according to a KCRA News report.

California Highway Patrol officer Troy Rivers said the fog was so thick that visibility was limited to about 100 feet at the time.

“At freeway speed, that’s a blink of an eye,” Rivers said.

A motorist called the CHP to report that a man who appeared to be in his 20s was pushing a disabled Chevrolet Malibu on southbound I-5 near March Lane, ABC Channel 10 News reported. There are no shoulders on that part of the freeway due to construction on the road.

As police were responding, a Honda Accord traveling about 60 mph slammed into the man and his car from the rear. The driver said that he did not see the man because of the dense fog. When he did see the man, the driver swerved to try to avoid hitting him but it was too late.

The man who was pushing the car died at the scene. CHP officers found him underneath his vehicle. They said he likely died immediately on impact.

CHP investigators said fog was definitely a factor in the accident, but they had not yet determined whether the Accord driver was at least partially at fault.

The lack of shoulders on the freeway also added to the dangerous road conditions because there was no place the victim could have moved his car or himself away from traffic.

Driving in Fog

“The best advice for driving in the fog is DON’T,” warns the California Department of Motor Vehicles handbook. The dangers of extremely reduced visibility warrant postponing any unnecessary trips. If you must drive in fog, however, the DMV handbook offers these tips:

  • Drive slowly.
  • Use your low-beam headlights. High-beam headlights will reflect back and cause glare.
  • Never drive with just your parking or fog lights.
  • Increase your following distance and be prepared to stop within the space you can see ahead.
  • Avoid crossing or passing lanes of traffic unless absolutely necessary.
  • Listen for traffic you cannot see.
  • Use your wipers and defroster as necessary for best vision.

If the fog becomes so thick that you can barely see, pull completely off the road. Turn off your lights and be sure to keep your foot off of the brake pedal or someone may see your taillights, think you are moving, and drive into your vehicle.

Amusement Park Accident Lawyer | Knott’s Berry Farm Introduces Accident Prevention Measures

Knott’s Berry Farm has introduced measures to prevent injuries on one of its popular attractions, Pro Slide Tornado, also known as Pacific Slim. The park will now weigh riders before admitting them into the queue.  This determines how they are to be seated in the various raft configurations. A red light will determine the group is too heavy, a yellow light means a group of 4 is up to 700 lbs, and a green light means a group of 2 is up to 200 lbs. Riders will not be able to ride solo.

Cal-OSHA (Occupational Safety and Health Administration) ordered Knott’s to add the regulation after an accident on August 24th of 2009 plus a string of other incidents attributed to over-weight rafts.  In one such incident, a woman scraped her elbow and had bodily pain after falling out of the raft. Prior to August, Knott’s had been repeatedly reprimanded by the state of California to re-train operators to separate heavier groups but to no avail. This procedure will be exclusive to Pacific Spin while the other slides and attractions of Knotts’ water park will do without them.

Culver City Accident Lawyers | CHP Officer Critically Injured by I-405 Speeder

Interstate 405 was closed in both directions and a California Highway Patrol officer was critically injured on Wednesday morning in a speeding accident near the junction of Interstate 10 in Los Angeles.

The officer — a 27-year veteran, according to an Associated Press report in the San Jose Mercury News — had pulled over a Honda SUV and was standing next to the vehicle. An Infiniti sedan came speeding down the shoulder and crashed into the officer, shoving him and his motorcyle into the stopped SUV. The impact was so forceful it flipped the SUV and pinned the officer in the middle of the tangled wreck, a CHP spokesman said.

The officer was in critical condition, according to Fox11 News. An eyewitness said he was in cardiac arrest when he was loaded into an ambulance and rushed to the UCLA Medical Center trauma unit.

The driver and passenger in the SUV were seriously injured, as was the driver of the Infiniti, according to the Los Angeles Daily News. All of them were taken to the hospital to be treated.

Sgt. Mark Garrett of the CHP told the Daily News that investigators will interview the driver of the Infiniti to determine what, if any, charges will be filed against him.

UPDATE:

Officer Phillip Ortiz died at 5:50 p.m. June 22 at Ronald Reagan UCLA Medical Center in Westwood. The accident is still under investigation.

California Accident Lawyers | Elderly Pedestrian Killed By SUV

A 91-year-old pedestrian was killed when he was hit by an SUV while attempting to cross a street Sunday afternoon in Oroville, California. Neither he nor the driver of the SUV saw each other in time to avoid the fatal accident.

Jeremiah Wayman, the 25-year-old driver of the Toyota 4Runner, said he didn’t see Robert Mullin step into the intersection in time to avoid the collision, according to a report in the Chico Enterprise-Record.

Mullin was trying to cross Skyline Boulevard at Highway 162 when the 2:15 p.m. accident occurred. California Highway Patrol investigators said Mullin, who was walking northbound, did not see the westbound SUV coming. The elderly man was rushed to Oroville Medical Center, where he was pronounced dead at 2:45 p.m., approximately a half-hour after the collision. Wayman was not injured.

The CHP is investigating the accident.

Sonoma Car Accident Lawyers | Driver Runs Himself Over

A slow-speed side swipe became a fatal car accident Thursday when a driver got out of his car and ran over himself.   Jorge Bacab-Cab, who was traveling around 25 mph on a downtown Sonoma street around 6 p.m., hit a parked van, according to the Napa Valley Register.

The California Highway Patrol said the right-side tires of 37-year-old Bacab-Cab’s car were off the ground, up against the left side of the van. He then opened the driver-side door and started backing up.  For reasons yet unknown, Bacab-Cab got out of his car and was run over by it.   He was pronounced dead at the scene.

Neither of the two passengers in Bacab-Cab’s car—Francisco Bacab, 38, and Benedicto Rodriguez, 74—was injured.

The CHP is still investigating the accident. Authorities have not yet determined whether alcohol was a factor.
