Broken bones, or fractures, can be simple or complex. Simple or non-displaced fractures (broken parts do not separate – but have a “hairline fracture”) usually heal without long-lasting effect in about 6 weeks. Badly broken bones, however, as in displaced fractures (broken parts separate) or more seriously shattered bones, as in spiral fractures or comminuted fractures, frequently require surgery that uses screws, plates or rods. These surgeries may be internal, where the surgeon opens up the patient, sets the broken parts of the bones in their correct position and secures them in place with hardware. This surgery is called ORIF, for “open reduction and fixation”, and has a much longer healing time, and may have long-lasting ill effects which can limit a person’s functioning. In the case of severely broken bones the complex surgery may involve hardware that comes through the skin as well, and is referred to as “external fixation”. External fixation surgeries can have complications due to infections and may cause permanent disability and a lifetime of pain and suffering.

At Blackman Legal Group, we have experience representing victims of serious accidents who have suffered a wide variety of serious fractures, including many who required complex surgical repairs, as well as many individuals that were placed in casts while their broken bones healed.

The Blackman Legal Group brings over 32 years of specialized experience to people who have been injured because of the negligence, careless or illegal acts of another person or company, including people who have suffered broken bones or fractures. We combine our extensive experience with a commitment to thorough preparation, paying attention to every detail as we work to get full and fair compensation for all your losses.

Because of our meticulous preparation and our excellent reputation in the field of personal injury litigation, we are often able to settle claims at insurance policy limits, and in cases of insurance bad faith have recovered settlements for clients in excess of the policy limits. We have recovered multi-million dollar settlements and verdicts for our clients who suffered serious fractures requiring surgery and causing long-term disability. In a recent lawsuit involving an elevator accident, we recovered a settlement of over $6.4 million for our seriously injured client after a jury trial in San Francisco.

Protecting Victims of Fractures and Broken Bones

If you have suffered a fracture, you will most likely be fit with a cast and may require rehabilitation or physical therapy once the cast is removed. In cases of comminuted fractures, or spiral fractures, or other displaced fractures, there is frequently the need for internal fixation surgery (where plates and screws are used) or in more severe and complex fractures where external hardware is used in conjunction with the internal fixation to maintain stability while the broken bones heal. In some situations, a broken bone may not properly heal or knit together. We will work with you throughout the course of your injury and recovery, making certain that you receive full and fair compensation for any long-term effects.

Over the last 32 years, we have built strong relationships with other professionals, including accident reconstruction experts, bio-mechanical experts, orthopedic surgeons, spinal surgeons, other medical specialists, life-care planners and financial experts, all of whom help us put together the best case to demonstrate to an insurance company or a jury the full extent of your injury and why you deserve a substantial settlement as compensation.

Helpful Tips

If you suffered broken bones in an accident and are pursing a claim or a lawsuit as a result, the proof of what you went through can be helped greatly if you do two things.

  1. Take photos of your injuries including your cast and the scars from your surgery, if you had one. Date the photos and keep them for your attorney to use.
  2. Keep a diary about your pain, suffering and emotional distress as a result of your broken bone injuries. This diary will be very useful in your case as an accurate way to remember what you had to go through, so you can testify accurately and honestly.
